Terms and Conditions for Photography Packages
Welcome to Sam Hoo Photography! Please read these Terms and Conditions carefully before purchasing any photography packages. By using our services and purchasing our packages, you agree to be bound by the following terms and conditions:
1. Services Offered
Sam Hoo Photography offers a variety of photography packages and services, as described on our website (https://www.samhoophotography.com/plans-pricing). The details of each package, including pricing and inclusions, can be found on the website.
2. Customer Information and Privacy
a. By booking a photography package with Sam Hoo Photography, you consent to the collection and use of your personal information as described in our Privacy Policy. We may use the information you provide, including but not limited to your name, contact details, and event details, for the purpose of delivering our services and for marketing future products and services.
b. We take your privacy seriously and will never share your personal information with third parties without your consent, except as required by law or as specified in our Privacy Policy.
3. Payment, Downpayment, and Refunds
a. A non-refundable down payment of 25% of the total price of the photography service is due at the time of booking. This down payment will be deducted from the final total price of the service.
b. All payments, including the down payment, are non-refundable, except as expressly stated in our refund policy, also outlined on our website.
c. Once a photography service is performed, and a digital photo album is delivered to the customer, no refunds will be granted. By accepting and downloading the digital photo album, you acknowledge the satisfactory completion of the service and waive any right to request a refund for that specific service.
4. Copyright and Usage Rights
a. Sam Hoo Photography retains full copyright to all photographs taken during the photography session, including the right to use, reproduce, and display the photographs for promotional and marketing purposes. By booking our services, you grant us a non-exclusive license to use the images for these purposes.
b. You may use the photographs for personal use, including sharing them on social media and with friends and family. However, you may not sell, license, or otherwise commercially exploit the photographs without our written permission.
5. Cancellation and Rescheduling
a. If you need to cancel or reschedule your photography session, please contact us as soon as possible. Cancellation and rescheduling policies, including any associated fees, are outlined on our website.
6. Photographer's Right to Refuse Service
a. Sam Hoo Photography reserves the right to refuse service to any customer, for any reason, at any time. We are committed to maintaining a safe and respectful working environment for our photographers and staff.
7. Liability
a. Sam Hoo Photography is not liable for any loss, damage, or injury that may occur during the photography session, including but not limited to equipment failure, accidents, or adverse weather conditions. You agree to hold us harmless and release us from any liability in such situations.
8. Governing Law
a. These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Sam Hoo Photography is located.
9. Changes to Terms and Conditions
a. Sam Hoo Photography reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them periodically.

11. Force Majeure
a. Sam Hoo Photography shall not be held responsible or liable for any delay or failure in the performance of its obligations under this contract due to any unforeseen circumstances or events beyond its reasonable control, including, but not limited to, acts of nature, fire, flood, earthquake, pandemic, government actions, war, terrorism, riots, civil unrest, labor strikes, power outages, or any other force majeure event.
b. In the event of a force majeure event, Sam Hoo Photography may, at its discretion, either (i) suspend its obligations under this contract for the duration of the force majeure event or (ii) terminate this contract without liability to the parties involved.
c. Sam Hoo Photography will make reasonable efforts to promptly notify the customer of the occurrence of a force majeure event and its impact on the photography services. The customer acknowledges that the nature of photography services may require flexibility regarding scheduling and that some aspects of the services may be altered or postponed due to a force majeure event.
d. In the event of termination due to force majeure, any payments made by the customer for services not yet rendered will be refunded, minus any reasonable expenses incurred by Sam Hoo Photography up to that point.
By booking a photography package with Sam Hoo Photography, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
